If you're being called by a debt collector because you are late in paying your bills, you need to know how to deal with the debt collectors in order to get the calls to stop. Dealing with debt collectors can be frustrating experience. Her are some tips to help you deal with debt collection agencies:

Know Your Rights When You Talk to a Debt Collector.

bulletYou have the right to be treated fairly, with respect, and to have your privacy respected.
bulletNot be threatened, or listen to obscene language.
bulletDispute the debt, or even that you owe the money.
bulletRequest that you not be contacted at work, at a friend or relative's house, or at a time and place that is inconvenient for you.
bulletRequest that no further attempts to contact you be made.

Ask Questions About the Debt and The Collection Agency.

bulletWhen you speak with a collection agency get as much information as possible:
bulletAsk for the name of the agent and the collection agency.
bulletAsk for the address and phone number for sending correspondence to the collection agency.
bulletAsk for the name of the creditor and the amount the collector claims you owe.

Start a File Detailing Your Steps in Dealing With the Agency.

bulletYour file should include but not limited to:
bulletDates and times of phone conversations or messages left on voice mails. Include the name of the agent calling and a summary of the conversation or the message.
bulletCopies of correspondence you send or receive, including envelopes and certified mail receipts.

Important: Put Everything In Writing When Dealing With a Collection Agency

bulletEverything that you send to a debt collection agency should be sent by Certified Mail, Return Receipt Requested. If you dispute the debt during a phone call, follow up that call with a letter detailing the phone conversation in writing.
bulletIf you request that you not be called again by the debt collector, follow up that request in writing, a debt collector isn't required to stop calling you just because you've just asked. The law states that such requests must be made in writing.

Understand What You Owe To the Debt Collector or Creditor

bulletCarefully review the amount you are being asked to pay by the debt collector, and ask for a breakdown of the original debt as well as any interest, fees or charges that may be added.
bulletThe FDCPA prohibits a debt collector from charging any fees or charges which are not specifically permitted by the laws of your state, or contained in the terms of your original agreement with the creditor.

Complain About Abusive Debt Collection Practices

bulletUnder the FDCPA, a debt collector is not allowed to make express or implied threats, use abusive or profane language, discuss your debt with third parties, or harass you.
bulletIf the debt collector's actions are abusive and your attempts to get them to follow the law fail, you may need to speak with an attorney or other relevant federal and state laws.

Do Not Ignore Collection Calls or Letters from Debt Collectors.

bulletIt is in your best interest to respond to debt collection calls rather than avoid them. Avoiding calls will only result in more calls, and the collector may even file a lawsuit and get a judgment against you.
